States that require E-Verify - DHS 2020

Following is a video clip from SmartERP's E-Verify webinar, presented by the Department of Homeland Security. The short segment contains an overview that highlights the 20 states (now 22) that have enacted legislation mandating the use of E-Verify by employers within their state.

E-Verify is a voluntary program in many states; however, there are several caveats:
  • You have received a Federal contract that requires E-Verify.
  • If you're one of these highlighted states.
  • You fall within the guidelines of whatever law that your state has enacted.  
  • There are some states on the map, such as Arizona, Mississippi, and others that have mandatory E-Verify requirements for all employers.
  • Other states may require all employers that have more than five employees or all employers that have more than 25 or 50 employees must enroll in E- verify.
We encourage you to research your employment state, or if you have employees that are working in other states, you need to be aware of the E-Verify law as it pertains to the states your employees are working in.
